Elections case: Court demands report from AG

The Constitutional Court sitting in Lilongwe has asked Attorney General Kalekeni Kaphale to explain what has been done regarding the court's order to investigate Diverson Makweche on perjury charges.


Chairperson of the panel of five Constitutional Court justice Healy Potani said there is need for the AG Kalekeni to give a full report on the matter.


But Kaphale told the court that he was not ready with the report.


He asked court to be allowed to present the report on Wednesday this week to which the court agreed to.


The Constitutional Court ordered an investigation of Mr Makwete a MEC witness for failing to provide log books at an appropriate location where parties could inspect.

"Although this court has power to order trial before a resident magistrate court...the court is of the opinion that considering that Mr Makwete has not been heard personally held....it would be appropriate for law enforcement agencies to investigate where his acts did amount to perjury," said Potani.

The Constitutional court has since adjourned to Tuesday, tommorrow.


The five judges are hearing a case in which UTM party and MCP are seeking nullification of the May 2019 elections saying they contained a lot of irregularities.
